All orders will be accepted and fulfilled solely in compliance with these Terms and Conditions of DECHEMA Ausstellungs-GmbH (“DECHEMA”). Any divergent conditions from a customer are void. By placing an order, the customer acknowledges these Terms and Conditions, even if his order refers to different conditions. Additional covenants are legally binding only if we have confirmed them in writing. Special arrangements do not render the remaining Terms and Conditions invalid. The purchase of entry tickets for resale is generally prohibited.
Offers and prices are always non-binding. Prices become invalid when a new price list appears. Pursuant to § 4 No. 22 of the German Sales Tax Act (Umsatzsteuergesetz/UStG), entry tickets of ACHEMA 2027 are exempt of sales tax.
When the payment process is concluded on the appropriate website of DECHEMA or a service provider appointed by DECHEMA, or when the “Order” button is clicked, a valid contract comes into force on the basis of these Terms and Conditions.
When you have placed your order, you will receive a confirmation of order and invoice by email. If an order is not confirmed separately, the invoice serves as confirmation of the order.
Invoices are issued on behalf of DECHEMA e.V., 60486 Frankfurt, sales tax no. DE 114234833, by DECHEMA Ausstellungs-GmbH. An invoice serves as confirmation of the order unless the order is confirmed separately. Invoices are sent as a PDF file.
By placing an order for tickets online, the customer agrees that the ticket and invoice shall be sent via electronic channels. There is no entitlement to an invoice in paper form.
We refer specifically to the duty of entrepreneurs to store and archive electronically received documents under the terms of the German Fiscal Code (Abgabeordnung/AO), Sales Tax Act, Guidelines for IT-Supported Accounting Procedures (Grundsätzen ordnungsmäßiger DV-gestützter Buchführungssysteme/GoBS) and Guidelines Regarding Data Access and Verifiability of Digital Documentation (Grundsätzen zum Datenzugriff und zur Prüfbarkeit digitaler Unterlagen/GDPdU). Emails with invoices as PDF attachments sent by DECHEMA are to be collected and digitally stored under the terms of the GDPdU and § 14b of the Sales Tax Act.
DECHEMA shall not be liable for errors and for losses incurred by the invoice recipient as a result of improper action by him or inadequate technical resources with respect to invoices sent to him.
Moreover, DECHEMA shall not be liable for invoices or withholding tax deductions that are not recognized by the tax authorities, unless the non-recognition is attributable to DECHEMA.
Entry tickets are non-returnable and non-refundable. The nominal value of the ticket will be refunded only when an event is cancelled.
Payment for online tickets is by credit card, Apple Pay, Google Pay or Wero, without price deduction. Payment is processed by an external service provider. Separate regulations apply to exhibitors.
With respect to all gratuitous known and unknown types of use in all media, the customer agrees, with no time or geographical limitation, that DECHEMA or a third party acting under its authority may record him in video and/or sound in connection with an event and to use, process and, also in processed form, to reproduce, distribute, display, make publicly accessible and store such a recording wholly or partly, commercially or non-commercially, for the purposes of reporting, marketing and publicizing the event and DECHEMA.
The data required for your order will be collected, processed and used in compliance with the EU General Data Protection Regulation (GDPR). The general data protection regulation of DECHEMA under www.achema.de/privacy shall apply. DECHEMA or the service provider engaged by it uses encryption procedures to transmit your data securely. This means that other internet users cannot read communications between your browser and the DECHEMA booking system.
If urgent circumstances that are beyond the control of DECHEMA (for example industrial unrest, official or legal regulations) and/or force majeure (for example extreme weather, disasters, war, terrorism, fire, epidemics, danger to the life and health of attendees) occur, DECHEMA may postpone, curtail, close partly or completely, or cancel an event. This right applies to the entire event and individual parts thereof (for example the live and online portion of the event).
This does not give an attendee any entitlements to withdrawal, termination or reduction, or any other entitlements, especially claims against DECHEMA for losses incurred. The same applies when an attendee cannot attend an event due to force majeure or other reasons beyond the control of DECHEMA.
a) DECHEMA bears unlimited liability for losses incurred by a customer only insofar as they are attributable to malicious intent or gross negligence on the part of DECHEMA. In the event of minor breaches of obligations, DECHEMA is liable only for a breach of its significant contractual obligations (major obligations). In such a case, the liability of DECHEMA is limited to contractually typical losses suffered directly by the customer which were foreseeable at the time of conclusion of the contract. This also applies to breaches of obligations by legal representatives and/or agents of DECHEMA. This limitation of liability does not apply to death caused by negligence, culpable physical injury or health impairment.
b) Links may lead to the websites of service providers whose contents are beyond the scope of responsibility of DECHEMA. These links can be recognized as such by the context, or are specially marked. DECHEMA has no influence over the contents of such websites and the presence of links does not imply that DECHEMA shares these contents. In particular, DECHEMA dissociates itself explicitly from the opinions disclosed therein. Otherwise, responsibility on the part of DECHEMA is justified only if DECHEMA is aware of a breach of law and was reasonably capable of preventing its application (§ 8 para. 2 of the Telemedia Act (Telemediengesetz/TMG)). To a reasonable extent, DECHEMA shall inspect external contents for possible breaches of the law. Breaches of copyright, trademark rights or personal rights or violations of competition law on the websites of third party providers do not immediately attract attention, and we have as little knowledge of them as of the offences concerned. The contents of and the harm caused by the information on such websites are the sole responsibility of the provider, not the person or entity who merely provides a link to them. This disclaimer also applies as appropriate to entries and contributions by outside persons to guest books, discussion forums and mailing lists created by DECHEMA.
Should any provisions of this contract with the customer, including these General Terms and Conditions, be wholly or partly invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by one which comes as close as legally possible to the commercial objective of the original provision. The same applies to the filling of any contractual loopholes.
This contract shall be governed and construed solely in accordance with the laws of the Federal Republic of Germany, to the exclusion of the UN Sales Convention.
The sole place of jurisdiction for registered traders, for persons with no general place of jurisdiction in Germany, and for persons who relocated their domicile or habitual place of residence abroad after the contract was concluded, or whose domicile or habitual place of residence is not known when a claim is filed, is the registered office of DECHEMA in Frankfurt.
